"Your Freedom Depends on an Aggressive Lawyer Who Fights for Your Rights"
The Jim McEntee Law Firm offers aggressive, effective representation to all people accused of crimes. Jim
McEntee practices in and has extensive experience handling every kind of criminal case- from drunk driving to
capital homicide- in Solano, Contra Costa, Napa, and Alameda Counties.
We have extensive experience defending the rights of people arrested and accused of all types of criminal
offenses and at every stage of the case starting with the arrest. From the time we are retained as your legal
representative, we begin preparing for trial. Our firm has years of experience dealing with arraignments,
discovery, and preliminary hearings. Our firm keeps abreast of current legal developments so that we can draft
persuasive motions to suppress evidence and other pre-trial motions. We are skilled negotiators who will
plea-bargain if it is in your best interest and after we obtain your informed consent. But, we are prepared to
go to trial and vigorously defend you when that is in your best interest.
Our firm practices in all courts throughout the state and has successfully represented people accused of such
things as shoplifting, theft, domestic violence, assault & battery, and probation violations.
The firm's prompt personal attention to its clients, coupled with effective legal skills and professional
commitment, have earned them an outstanding reputation throughout Southern California and the Van Nuys, San
Fernando, Chatsworth and Sylmar Courthouses.
DUI AND FELONY DUI
California law separates DUI and Felony DUI. A felony DUI usually involves a serious injury. In either case, a
court date may be scheduled months after your arrest. However, this does not mean that there are not other
proceedings that threaten your ability to continue driving. The Department of Motor Vehicles (DMV) begins the
process to suspend your license immediately. These suspension proceedings typically seek to prohibit you from
driving from between four months and two years. State law requires that you contact the DMV within 10 days of
your arrest to schedule an administrative hearing to contest your suspension and extend your driving
privileges. This 10-day period includes weekends and holidays. We can help with this proceeding and we have a
hotline to the DMV and can schedule these hearings. Not requesting a hearing within the 10-day period will
result in the suspension of your driver's license.
If your license was taken at the time of your arrest, you were issued a temporary license (an administrative
per se license). Many of your rights and responsibilities are obtained in this document. The DMV and the
courts operate and are guided by different sets of rules and laws. It is important that you are aware of and
represented in both proceedings by a lawyer.
If you have missed this 10-day deadline, there are still things that we can do to remove or minimize your
license suspension. The key is to contact us immediately.
ALTERNATIVES TO JAIL
Our number one goal representing individuals who have been arrested is keeping them out of jail. There are
many alternatives to jail time, including house arrest, community service, or monetary fines. House arrest or
community service allows our clients to keep their jobs and continue supporting their families. Our firm has a
highly successful record of working out alternatives to jail time on behalf of our clients.
